1. Elegibilidad
Debes tener al menos 13 años para usar Flushy App. Al usar la app, declaras y garantizas que tienes al menos 13 años y la capacidad legal para aceptar estos Términos. 2. Descripción del servicio
Flushy App es una aplicación móvil que ayuda a los usuarios a encontrar baños públicos y lugares cercanos relacionados. La app permite ver ubicaciones en un mapa, añadir baños y puntos, dejar reseñas y calificaciones, escribir notas, intercambiar mensajes privados y conectarse socialmente con otros usuarios.
La app se ofrece únicamente con fines informativos y de conveniencia. No somos propietarios, ni operamos ni controlamos las ubicaciones físicas mostradas en la app.
3. Tu cuenta
Para usar ciertas funciones, debes crear una cuenta. Te comprometes a:
- Proporcionar información precisa y completa al registrarte.
- Mantener seguras y confidenciales tus credenciales de acceso.
- Ser responsable de toda la actividad que ocurra bajo tu cuenta.
- Notificarnos de inmediato cualquier uso no autorizado de tu cuenta.
Nos reservamos el derecho de suspender o cancelar las cuentas que infrinjan estos Términos o que razonablemente creamos que se usan con fines fraudulentos, abusivos o ilegales.
4. Contenido generado por el usuario
Flushy App te permite enviar contenido, incluidas ubicaciones de baños, reseñas, calificaciones, notas, mensajes, información de perfil y fotos ("Contenido del Usuario").
Conservas la propiedad de tu Contenido del Usuario. Sin embargo, al enviarlo, nos concedes una licencia no exclusiva, mundial y libre de regalías para alojar, almacenar, mostrar, reproducir y distribuir ese contenido dentro de la app con el fin de operar y prestar el servicio.
Eres el único responsable de tu Contenido del Usuario, y declaras que:
- Eres propietario o tienes los derechos necesarios sobre el contenido que envías.
- Tu contenido no infringe ninguna ley ni los derechos de terceros.
- Tu contenido es preciso según tu leal saber y entender.
5. Uso aceptable
Te comprometes a NO usar Flushy App para:
- Publicar ubicaciones, reseñas o calificaciones falsas, engañosas o fraudulentas.
- Enviar contenido ilegal, difamatorio, acosador, abusivo, obsceno, de odio o de otro modo objetable.
- Suplantar a una persona o entidad, o tergiversar tu afiliación.
- Acosar, amenazar o dañar a otros usuarios.
- Subir virus, código malicioso o intentar interferir con el funcionamiento o la seguridad de la app.
- Acceder o intentar acceder a las cuentas o datos de otros usuarios sin autorización.
- Usar sistemas automatizados (bots, scrapers) para acceder, manipular o inundar la app con contenido.
- Manipular calificaciones, reseñas o el mapa (por ejemplo, creando múltiples cuentas falsas o enviando reseñas de lugares que no has visitado).
- Usar la app con cualquier fin ilegal o en violación de estos Términos.
Nos reservamos el derecho de eliminar cualquier contenido y suspender o cancelar cualquier cuenta que infrinja estas reglas.
6. Moderación y eliminación de contenido
Podemos, sin estar obligados a ello, revisar, monitorear o eliminar Contenido del Usuario a nuestra discreción, incluido el contenido que creamos que infringe estos Términos o que de otro modo sea objetable. No somos responsables del Contenido del Usuario publicado por los usuarios.
7. Exactitud de la información — Aviso importante

8. Servicios de ubicación

9. Publicidad
Flushy App es de uso gratuito y se sostiene con publicidad. La app muestra anuncios a través de Google AdMob. No somos responsables del contenido de los anuncios de terceros ni de los productos o servicios anunciados. Tus interacciones con los anunciantes son únicamente entre tú y el anunciante.
10. Servicios de terceros
La app depende de servicios de terceros, incluidos Google Firebase, Google AdMob y OpenStreetMap. Tu uso de estos servicios puede estar sujeto a sus propios términos y políticas. No somos responsables de las prácticas de estos terceros.
11. Propiedad intelectual
La app, incluido su diseño, funciones, logotipos y contenido original (excluyendo el Contenido del Usuario), es de nuestra propiedad y está protegida por las leyes de propiedad intelectual. 15. Indemnización

16. Terminación

1. Eligibility
You must be at least 13 years old to use Flushy App. By using the app, you represent and warrant that you are at least 13 years of age and that you have the legal capacity to enter into these Terms. If you are between 13 and the age of majority in your jurisdiction, you confirm that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.
2. Description of the Service
Flushy App is a mobile application that helps users find public bathrooms and related nearby places. The app allows users to view locations on a map, add bathrooms and points, leave reviews and ratings, write notes, exchange private messages, and connect socially with other users.
The app is provided for informational and convenience purposes only. We do not own, operate, or control the physical locations shown in the app.
3. Your Account
To use certain features, you must create an account. You agree to:
- Provide accurate and complete information when registering.
- Keep your login credentials secure and confidential.
- Be responsible for all activity that occurs under your account.
- Notify us promptly of any unauthorized use of your account.
We reserve the right to suspend or terminate accounts that violate these Terms or that we reasonably believe are being used for fraudulent, abusive, or illegal purposes.
4. User-Generated Content
Flushy App allows you to submit content, including bathroom locations, reviews, ratings, notes, messages, profile information, and photos ("User Content").
You retain ownership of your User Content. However, by submitting it, you grant us a non-exclusive, worldwide, royalty-free license to host, store, display, reproduce, and distribute that content within the app for the purpose of operating and providing the service.
You are solely responsible for your User Content, and you represent that:
- You own or have the necessary rights to the content you submit.
- Your content does not violate any law or the rights of any third party.
- Your content is accurate to the best of your knowledge.
5. Acceptable Use
You agree NOT to use Flushy App to:
- Post false, misleading, fraudulent, or fake locations, reviews, or ratings.
- Submit content that is unlawful, defamatory, harassing, abusive, obscene, hateful, or otherwise objectionable.
- Impersonate any person or entity, or misrepresent your affiliation.
- Harass, threaten, or harm other users.
- Upload viruses, malicious code, or attempt to interfere with the app's operation or security.
- Access or attempt to access other users' accounts or data without authorization.
- Use automated systems (bots, scrapers) to access, manipulate, or flood the app with content.
- Manipulate ratings, reviews, or the map (for example, by creating multiple fake accounts or submitting reviews for places you have not visited).
- Use the app for any illegal purpose or in violation of these Terms.
We reserve the right to remove any content and suspend or terminate any account that violates these rules.
6. Content Moderation and Removal
We may, but are not obligated to, review, monitor, or remove User Content at our discretion, including content that we believe violates these Terms or is otherwise objectionable. We are not responsible for any User Content posted by users.
7. Accuracy of Information — Important Disclaimer
The information in Flushy App, including bathroom locations, availability, accessibility, hours, and conditions, is provided by users and third-party sources (such as OpenStreetMap) and may be inaccurate, incomplete, or outdated.
We do not guarantee the accuracy, reliability, or availability of any location or information shown in the app. You use this information at your own risk. We are not responsible for any inconvenience, loss, or harm resulting from reliance on information provided in the app.
Always exercise your own judgment, and respect the rules and private property of the locations you visit.
8. Location Services
The app uses your device's location to show nearby places and your position on the map. You can control location permissions through your device settings. Disabling location may limit certain features.
9. Advertising
Flushy App is free to use and is supported by advertising. The app displays ads through Google AdMob. We are not responsible for the content of third-party advertisements or for any products or services advertised. Your interactions with advertisers are solely between you and the advertiser.
10. Third-Party Services
The app relies on third-party services, including Google Firebase, Google AdMob, and OpenStreetMap. Your use of these services may be subject to their own terms and policies. We are not responsible for the practices of these third parties.
11. Intellectual Property
The app, including its design, features, logos, and original content (excluding User Content), is owned by us and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works from the app without our prior written permission.
12. Privacy
Your use of Flushy App is also governed by our Privacy Policy, which explains how we collect, use, and protect your information. By using the app, you consent to the practices described in the Privacy Policy.
13. Disclaimer of Warranties
The app is provided on an "as is" and "as available" basis, without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the app will be uninterrupted, error-free, secure, or free of harmful components.
14. Limitation of Liability
To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or goodwill, arising from your use of or inability to use the app, even if we have been advised of the possibility of such damages.
15. Indemnification
You agree to indemnify and hold harmless Gabriel Guzman and Flushy App from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the app, your User Content, or your violation of these Terms.
16. Termination
We may suspend or terminate your access to the app at any time, with or without notice, for any reason, including violation of these Terms. You may stop using the app and delete your account at any time.
17. Changes to These Terms
We may update these Terms from time to time. We will post any changes on this page and update the "Last updated" date. Your continued use of the app after changes take effect constitutes acceptance of the revised Terms.
18. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the United States and the State of Texas, without regard to conflict of law principles, unless otherwise required by applicable local law.
